INFORMATIVE CLAUSE

In compliance with the principles of lawfulness and transparency and in order to provide the information to data subjects established in Articles 13 and 14 of the European Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), we hereby inform you of the characteristics of the processing of personal data carried out under the responsibility of LIVINGSEA, S.L.

PURPOSE
    1. Manage the necessary human resources to carry out the activities and services of LIVINGSEA, S.L.
    2. Attention to requests received through the web form.
    3. Preparation of invoices to clients, preparation of official accounting and calculation, presentation and settlement of taxes, preparation of commercial documents, such as balance sheets and reports.
    4. Administrative management related to the development of the activity.
    5. Registering clients for accounting and cash control purposes.
    6. Dealing with requests for the exercise of rights related to personal data, as well as security breaches that may affect the rights and freedoms of data subjects.
    7. Course management, collection and processing of students’ personal data for the registration and execution of the course.
    8. Sending commercial information.
    9. Promoting future company events.
LEGITIMACY
    1. Points 1 and 7. Application of contractual and pre-contractual measures.
    2. Points 2 and 4. Provision of a service.
    3. Point 3. Legal obligation imposed by accounting and tax regulations.
    4. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data.
    5. Points 8 and 9. Consent of the data subject.
CONSERVATION PERIOD
    1. Points 1, 3, 5, 6 and 7. Six years as this is the maximum period imposed by commercial law and for civil liability actions.
    2. Points 2 and 4. The period necessary to comply with the request or carry out the procedure.
    3. Points 8 and 9. As long as the data subject does not unsubscribe from any communication received, and the period necessary to comply with the responsibilities that may arise from all the above processing.

Exercise of rights: You may exercise your right of access, rectification, deletion, limitation and opposition to processing, under the terms and conditions established in the RGPD, by sending a request by email to info@livingsea.es or by sending a written request to: Calle Francisco Gourié, 65, 6º, Las Palmas de Gran Canaria, CP 35002, Las Palmas, indicating in all cases the Reference: “Data Protection” together with some document that accredits your identity such as a photocopy of your ID card, as well as to file a complaint with the Spanish Data Protection Agency.

WHO IS RESPONSIBLE FOR YOUR DATA?

The owner of the company and of this website is LIVINGSEA, S.L., so that any personal data that you communicate to us through this website or through the data collection forms that you fill out in person will be processed under the responsibility of LIVINGSEA, S.L.

WHAT PERSONAL DATA DO WE COLLECT? HOW DO WE COLLECT IT?

We will ask you for the minimum data necessary to carry out the purposes indicated in the following section, normally name and surname, address and contact details.

HOW DO WE USE THE PERSONAL DATA WE MANAGE UNDER OUR RESPONSIBILITY?

We use your data for the following purposes:

    • Fiscal, accounting and commercial management.

And the use we make of them is exclusively that indicated for each of the purposes described. In all other cases, we will process your data when we are required to do so by law, when there is a public interest such as in the case of video surveillance or to carry out essential activities in relation to the provision of services to customers, we do not communicate or process data for purposes other than those described.

FOR HOW LONG?

When the processing of data is imposed by a regulation, this regulation normally incorporates the period during which the data must be processed or stored, for example, the Commercial Code establishes the obligation to keep data for accounting and commercial purposes for six years, and the Civil Code allows the exercise of actions derived from the execution of a contract or the provision of a service for five years after the end of the contract or service.

DISCLOSURE TO THIRD PARTIES

As in the previous cases, the data that we communicate to third parties is always limited to the minimum necessary in relation to each of the purposes.

What security measures do we apply to personal data?

LIVINGSEA, S.L., has appropriate policies and technical and organisational measures in place to safeguard and protect your personal data against unlawful or unauthorised access, accidental loss or destruction, damage, unlawful or unauthorised use and disclosure. These measures are set out and updated in a document identified as the “Security Manual”. We will also take all reasonable precautions to ensure that our staff and employees who have access to your personal data have received appropriate training.

WHAT ARE YOUR RIGHTS AS A DATA SUBJECT?

You have the right to request the deletion of your data when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

You have the right to obtain confirmation as to whether or not LIVINGSEA, S.L. is processing your personal data.

You have the right to access your personal data and obtain a copy of them, as well as to request the rectification of inaccurate data or, where appropriate, request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, you may request the limitation of the processing of your data, in which case we will only keep them for the exercise or defence of claims.

In certain circumstances and for reasons related to your particular situation, you may oppose the processing of your data.

LIVINGSEA, S.L., will stop processing the data, except for compelling legitimate reasons, or the exercise or defence of possible claims.

Likewise, you may exercise your right to data portability, as well as revoke any consent you may have provided.

You may exercise these rights by sending a request by e-mail to info@livingsea.es or by sending a written request to: Calle Francisco Gourié, 65, 6º, Las Palmas de Gran Canaria, CP 35002, Las Palmas, attaching a copy of your ID card or other document proving your identity, and clearly indicating the right you wish to exercise.

Finally, we would like to point out that you can file a complaint with the Spanish Data Protection Agency, especially when you have not obtained satisfaction in the exercise of your rights.
